1. Introduction

These Terms and Conditions ("Terms") govern your use of the Revelution AI Employee service and website located at www.revelution.co.za ("Service," "Platform," or "Website"). By accessing or using our Service, you agree to be bound by these Terms. Revelution (referred to as "we," "us," or "our") is operated in South Africa and provides AI-powered phone answering and lead management services. If you do not agree to these Terms, please do not use our Service.

2. Definitions

"AI Employee" refers to our artificial intelligence-powered phone answering system.

"Client" or "you" refers to the individual or entity subscribing to our Service.

"Subscription" refers to your paid access to the Service.

"Content" refers to all data, information, recordings, and materials processed through the Service.

3. Eligibility

You must be at least 18 years of age, legally capable of entering into binding contracts, operating a legitimate business, and authorized to bind your organization to these Terms (if applicable).

4. Service Description

Revelution provides an AI Employee service that:

Answers inbound phone calls 24/7

Records and transcribes phone conversations

Generates and captures lead information

Sends automated follow-up communications (SMS and email)

Routes calls according to custom parameters

Provides call summaries and notifications

Handles multiple simultaneous calls

5. Account Registration and Security

5.1 Account Creation

You agree to provide accurate, current, and complete information; maintain and update your account information; keep your login credentials confidential; and notify us immediately of any unauthorized access.

5.2 Account Responsibility

You are responsible for all activities conducted through your account and for maintaining the confidentiality of your password.

6. Subscription and Payment Terms

6.1 Pricing

Monthly subscription: R 4,998/month. Pricing is subject to change with 30 days' notice. All prices are in South African Rand (ZAR) and include VAT where applicable.

6.2 Payment

Payment is due monthly in advance. Accepted payment methods will be specified during registration. Failed payments may result in service suspension. You authorize us to charge your payment method on a recurring basis.

6.3 Money-Back Guarantee

We offer a 14-day money-back guarantee from the date of initial subscription. To request a refund within this period, contact our support team. If a refund is requested during the 14-day guarantee period, you will be charged for actual usage incurred during that period, including but not limited to:

Costs associated with calls answered by the AI Employee

SMS messages sent

Email automations triggered

Any other billable activities or resources consumed

The refund amount will be calculated as the subscription fee minus the usage costs. Usage will be calculated at our standard rates or cost-plus basis, whichever is applicable.

6.4 Cancellation

You may cancel your subscription at any time. Cancellations must be submitted through your account dashboard or in writing. No refunds will be provided for partial months (except within the 14-day guarantee period). Service will continue until the end of your current billing cycle.

7. Use of Service

7.1 Permitted Use

You may use our Service only for legitimate business purposes, including receiving and managing inbound calls to your business, lead generation, and customer communication, and you must comply with all applicable laws and regulations.

7.2 Prohibited Use

You may NOT use our Service to:

Violate any laws, regulations, or third-party rights

Engage in fraudulent, deceptive, or misleading practices

Harass, abuse, or harm individuals

Transmit malware, viruses, or harmful code

Make unsolicited calls (spam or telemarketing violations)

Impersonate others or misrepresent your identity

Interfere with or disrupt the Service

Bypass security measures or access restrictions

Use the Service for any illegal activities

Record calls without proper consent where required by law

8. Data and Privacy

8.1 Data Collection

We collect and process call recordings and transcriptions, lead information captured during calls, contact details and communication data, account and billing information, and usage analytics and performance data.

8.2 Data Ownership

You retain ownership of your business data and lead information. We claim no ownership rights to your Content.

8.3 Privacy Policy

Our collection and use of personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference.

8.4 Data Protection Compliance

We comply with the Protection of Personal Information Act (POPIA) and other applicable South African data protection laws.

8.5 Call Recording Consent

You are responsible for ensuring compliance with all applicable laws regarding call recording and obtaining necessary consent from callers where required.

9. Intellectual Property

9.1 Our Rights

All rights, title, and interest in the Service, including software, technology, designs, trademarks, and related intellectual property, remain our exclusive property.

9.2 License Grant

We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service in accordance with these Terms.

9.3 Restrictions

You may not copy, modify, or create derivative works of the Service; reverse engineer or attempt to extract source code; resell, lease, or sublicense the Service; or remove proprietary notices or labels.

10. Service Availability and Performance

10.1 Uptime

While we strive for maximum availability, we do not guarantee uninterrupted or error-free service.

10.2 Maintenance

We may perform scheduled or emergency maintenance that temporarily interrupts service. We will provide reasonable notice when possible.

10.3 No Warranty

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

11. Limitation of Liability

11.1 Liability Cap

TO THE MAXIMUM EXTENT PERMITTED BY SOUTH AFRICAN LAW, OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING FROM OR RELATED TO THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE 12 MONTHS PRECEDING THE CLAIM.

11.2 Excluded Damages

WE SHALL NOT BE LIABLE FOR:

Indirect, incidental, special, consequential, or punitive damages

Lost profits, revenue, data, or business opportunities

Cost of substitute services

Damages arising from your use or inability to use the Service

Missed calls or lost leads

Actions taken or not taken based on call summaries or AI recommendations

11.3 Force Majeure

We are not liable for delays or failures in performance resulting from causes beyond our reasonable control, including telecommunications failures, internet outages, natural disasters, or government actions.

12. Indemnification

You agree to indemnify, defend, and hold harmless Revelution, its officers, directors, employees, and agents from any claims, losses, damages, liabilities, and expenses (including legal fees) arising from your use of the Service, your violation of these Terms, your violation of any laws or third-party rights, Content you provide to the Service, or your failure to obtain proper consent for call recording.

13. Termination

13.1 Termination by You

You may terminate your subscription at any time as described in Section 6.4.

13.2 Termination by Us

We may suspend or terminate your access immediately if you breach these Terms, your payment fails or your account is delinquent, your use poses security or legal risks, or we discontinue the Service (with 30 days' notice).

13.3 Effect of Termination

Upon termination, your access to the Service will cease. You remain responsible for all charges incurred. We may delete your data after a reasonable retention period. Sections that by their nature should survive will remain in effect.

14. Modifications to Terms

We reserve the right to modify these Terms at any time. We will provide notice of material changes by posting updated Terms on our Website, emailing registered users, or providing notice within the Service. Continued use of the Service after changes constitutes acceptance of modified Terms.

15. Modifications to Service

We reserve the right to modify, suspend, or discontinue any part of the Service; change pricing with 30 days' notice; add or remove features; and update the AI Employee's capabilities.

16. Third-Party Services

The Service may integrate with or contain links to third-party services. We are not responsible for the content, policies, or practices of third parties.

17. Disputes and Governing Law

17.1 Governing Law

These Terms are governed by the laws of the Republic of South Africa, without regard to conflict of law principles.

17.2 Jurisdiction

Any disputes arising from these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of South Africa.

17.3 Dispute Resolution

Before initiating legal proceedings, parties agree to attempt to resolve disputes through good-faith negotiation for at least 30 days.

18. General Provisions

18.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Revelution regarding the Service.

18.2 Severability

If any provision is found unenforceable, the remaining provisions will remain in full effect.

18.3 Waiver

Our failure to enforce any right or provision does not constitute a waiver of that right or provision.

18.4 Assignment

You may not assign or transfer these Terms without our written consent. We may assign these Terms without restriction.

18.5 No Agency

These Terms do not create any agency, partnership, or joint venture relationship.

18.6 Electronic Communications

You consent to receive communications from us electronically, and agree that electronic communications satisfy any legal requirement for written communications.
